Florida’s controversial plan to purge ineligible voters from the rolls does not violate federal law, a judge said Wednesday in denying a U.S. Department of Justice request for an emergency restraining order, the New York Times reports.

U.S. District Court Judge Robert Jinkle said federal laws do not prevent states from removing ineligible voters from its rolls.

The judge also criticized the state and federal governments for failing to come together in search of a solution.

Federal officials claim Florida’s purging plan is likely to remove eligible voters from the rolls.

Florida started the effort after identifying about 182,000 names of potential noncitizens.
