Pot Activists Asking Federal Court to Reclassify Marijuana in Potential Landmark Case

The long, bitter fight between state and federal governments over the enforcement of marijuana is to land in the nation’s second-highest court this week, the Associated Press reports.

The case, driven by pot activists, seeks to challenge the DEA’s classification of pot as a Schedule 1 drug, which means it has no acceptable medical value.

The Justice Department said no evidence exists to prove marijuana’s safety and effectiveness as a medicine.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit will begin hearing arguments Tuesday.

The case is important because the federal government continues to prosecute marijuana distributers, even in states where the sale of pot as a medicine is permitted by state law.
