Justice Department Threatens to Yank Federal Funding to States Over Prison Compliance

States have two choices: Comply with federal prison standards to reduce inmate rape or lose federal grant money.

The Montgomery Advertiser reports that the Justice Department sent all 50 states a letter last week warning that would lose 5% of their federal funding if they are in compliance with the Prison Rape Elimination Act.

The deadline to respond is May 15.

The letter comes just a month after the Justice Department released a report that showed serious problems, including inmate rape, at the Julia Tutwiler Prison for Women in Wetumpka, Ala.

Feds Warn Alabama Law Enforcement Over Immigration Law

The Feds are pushing back on the state of Alabama.

The Justice Department’s Civil Rights Division warned 156 local law enforcement agencies they could lose their federal funding if they fail to comply with federal civil rights laws while enforcing the state’s harsh immigration laws, according to Talking Points Memo.

“As you undertake law enforcement activity under H.B. 56, it is critical that your enforcement of this law does not result in the unlawful stopping, questioning, searching, detaining, or arresting of persons in violation of the Fourth and Fifth Amendments, or in the targeting of racial or ethnic minorities in a manner that violates the Fourteenth Amendment,” Assistant Attorney General Thomas E. Perez wrote in a letter sent to reporters on Tuesday, according to Talking Points Memo.

Local law enforcement agencies are required to comply with certain federal non-discrimination requirements while receiving federal funding, Perez wrote; the feds are able end funding or bring a civil suit in federal court for noncompliance.

Justice Dept. Threatens to Withhold Funds From Police Depts. That Don’t Require Body Armor

WASHINGTON — No body armor, no cash.

That’s what the Justice Department is saying.

USA Today reports that the Justice Department is threatening to withhold millions of federal dollars from  local police departments that don’t require uniformed officers to wear body armor.

The threats come in wake of a spike in fatal shootings of cops. Body armor is not required at 41 percent of the nation’s police departments, USA Today reports.

“What struck us is the number of agencies that don’t have a mandatory policy … a potential huge vulnerability,” Jim Burch, acting director of the department’s Bureau of Justice Assistance, told USA Today. “If we’re investing federal dollars, we should require agencies to have policies.”
