ATF Agent John Dodson Suing Time Over Fast and Furious Article

John Dodson, the special agent who blew the whistle on the Fast and Furious gunwalking scandal, is suing Time for libel, POLITICO has learned.

The lawsuit comes in response to a Fortune magazine article published in June that asserted Dodson had complained about the gunwalking in part because it was his fault guns had been intercepted, and because of a longstanding personal grudge with the ATF supervisor who had been tasked with overseeing the Fast and Furious operation. The article’s principle thesis is that the ATF “never intentionally allowed guns to fall into the hands of Mexican drug cartels.”

The lawsuit, “for an amount in excess of $75,000.00,” calls the article “fictitious in the sense that it contains facts that Defendant [Time Inc., which owns Fortune] knew to be false prior to publication.” It also charges Time with being “negligent, grossly negligent, willful and wanton” and says it “purposely avoided the truth” by failing to interview Dodson. The summons was issued on Oct. 15.

Police: Black Louisiana Woman Lied About Racists Lighting Her on Fire

 A 20-year-old Louisiana woman who claimed she was set on fire by racists who scrawled KKK and a racial slur on her car made up the incident, state police said Tuesday, the New York Daily News reports.

Police said forensic evidence shows Sharmeka Moffitt set herself on fire on Sunday and invented the story of a hate crime, which the FBI was investigating.

Moffitt received extensive burns on more than half her body, according to the Daily News.

“The evidence does not support the statement that she was attacked by three males,” said Louisiana State Police spokeswoman Lt. Julie Lewis.

The woman’s fingerprints were found on a lighter and lighter fluid, police said.

Local police will decide whether to charge Moffitt.

Loaded Handgun Found in Denver Airport Bathroom Belonged to DEA Agent

A DEA agent left a loaded .45-caliber Glock handgun on the back of a toilet seat in the restroom of a crowded Denver International Airport, the Houston Chronicle reports.

A traveler found the gun last week.

The newspaper reports the gun was returned to an unidentified agent who apparently forgot the weapon.

The DEA declined to comment.

“Incidents such as the one you described … fall within the scope of an (internal) investigation and DEA does not confirm, deny or comment on internal investigations,” Lisa Johnson, spokeswoman for the DEA’s Houston Division, told the Chronicle.

 

Border Patrol Opened Fire Along Mexican Border After Spotting Drug Smugglers

 Border Patrol agents exchanged gunfire with a suspected smuggler on the Mexican side of the Rio Grande, the San Antonio Express-News reports.

“Our agents are not going to tolerate this,” Border Patrol spokesman Henry Mendiola said Tuesday. “They’re well-trained, they’re well equipped, and they will respond to neutralize these threats.”

The Friday shooting began when agents spotted smugglers loading more than a half-ton of marijuana into an SUV, the San Antonio Express-News reported.

Someone fired at agents who were pursuing the driver and smugglers,

Agents returned fire.

There were no reports of injuries.

The suspected smugglers, all Mexican nationals, were arrested on drug charges.

Philly FBI Boss George C. Venizoles to Take Over New York Office

 George C. Venizelos, head of the FBI’s Philadelphia division, will be named assistant director in charge of the bureau’s New York field office, the Philadelphia Inquirer reports, citing anonymous sources knowledgeable of the move.

A New Jersey native, the 52-year-old served as interim assistant director in charge of the New York office for several months in 2010 until Janice Fedarcyk was given the job.

Venizelos became special agent in charge of the Philadelphia office, the same post Fedarcyk had held.

Fedarcyk left the bureau for the private sector this summer.

The FBI wouldn’t comment on Venizelos’ new job until there was an official announcement, possibly as early as today.

Ex-Border Patrol Officer Sentenced to 8 Years in Prison for Sexually Assaulting Mexican Woman

 A former U.S. Border Patrol officer was sentenced to eight years in prison Wednesday after admitting he sexually assaulted a Mexican woman traveling in the U.S., the Desert Sun reports.

Luis Edward Hermosillo was sentenced immediately after he pleaded guilty in Riverside County Superior Court to sexual penetration by threatening to use the authority of a public official and kidnapping.

Hermosillo was accused in court of pulling over the tourist and her two children, ages 2 and 5, in Indio, Calif.

Authorities said Hermosillo groped and penetrated the woman with his finger after he ordered her out of the car, the Desert Sun reported.
