Appeals Court Upholds Second-Degree Murder Conviction of Ex-FBI Agent John Connolly

Former FBI Agent John Connolly, who was charged with assisting now-imprisoned mob boss James “Whitey” Bulger, was rightfully convicted of second-degree murder with a firearm even though he was 1,500 miles away from his vicim at the time of the fatal shooting by a hit man, an appeals court ruled, the Associated Press reports. 

The full 3rd District Court of Appeals ruled 6-4 that Connolly’s conviction was proper because Connolly had a gun when he tipped off Bulger’s gang about John Callahan, who was fatally shot in Fort. Lauderdale in 1982.

“The evidence as to both his participation in the murder and his possession of a firearm during his participation are overwhelming,” Judge Leslie Rothenberg wrote on behalf of the majority. “The law does not require that the defendant be the actual shooter.”

The decision reverses that of a three-judge panel of the same court, the AP wrote.

An aging mobster and star government witness testified Tuesday that his heart was broken after learning that mob boss and friend James “Whitey” Bulger was an FBI informant, CNN reports.

“It broke my heart. It broke all loyalties,” said John Martorano, an alleged hit man who described the people he said he murdered. 

Bulger is accused of killing 19 people during nearly two decades.

Martorano, who lives on Social Security after serving 12 years in prison, testified that he pulled the trigger while Bulger was along to ensure a successful “hit.”

Former mob boss James “Whitey” Bulger will see a familiar face take the stand today in his murder and racketeering trial in Boston, Reuters reports.

A former hit man plans to testify against his ex-boss and uncover grizzly details of Bulger’s reign of terror.

Bulger, 83, faces a 32-count indictment stemming from his activities as the reputed boss of “Winter Hill Gang.”

On Friday, Richard O’Brien, a bookmaker who made illegal bets on sports, testified Friday that Bulger was a threatening force.

“Rather than being in the bookmaking business and taking the unknown gamble, they would take rent like you would for an apartment,” O’Brien testified.

Here’s an animal rights policy even PETA wouldn’t back: a Cleveland Heights woman is being charged with soliciting a hit man to randomly kill someone wearing a fur product, reports FOX Cleveland.

Meredith Marie Lowell, 27, was arrested shortly after the charges were announced on Tuesday, Special Agent with the FBI Stephen D. Anthony said.

Lowell had spoken over the internet with an undercover FBI agent several times seeking to have the agent carry out the murder so she could highlight her anti-fur stance, Fox reported.

FBI: Convicted Terrorist Sought Hits on Witnesses

The first rule about homegrown terrorist plots: don’t talk about homegrown terrorist plots.

Or so goes the code of a North Carolina prisoner recently sentenced on terrorism charges; federal court documents now allege the man plotted to kill witnesses that testified against him, including by decapitation, reports the Associated Press.

An affidavit unsealed on Monday accuses Hysen Sherifi of plotting to kill witnesses from his cell in prison, according to the AP.  An FBI informant posing as a hitman met with Sherifi’s brother and a female friend and was given $5,000 and a photo of one person to be targeted.

Sherifi, 27, got 45 years in prison earlier weeks ago in what the prosecution argued was a conspiracy to attack the Quantico, Va., Marine base and targets abroad.
