Prosecutors Clear Border Patrol Agents, Officers in Deadly Shooting in Las Cruces

Border Patrol agents, deputies and police officers will not be charged in connection with the shooting death of a suspect in the parking lot of a Las Cruces Home Depot, prosecutors told KRQE.

Investigators said the suspect, Francisco “Paco” Tarin, opened fire at a Las Cruces police officer who had responded to a June 17 call about a suspicious man threatening employees at a nearby Jack in the Box. While the officer drove himself to a hospital, a group of officers, deputies and border agents responded and found the suspect in the Home Deport parking lot.

After Tarin refused to surrender, he was shot with a non-lethe bean bag round. Tarin responded by shooting at the group of officers and agents, prompting them to return fire, killing the suspect.

The Officer-Involved Incident Task Force investigated the shooting and sent its findings to the district attorney’s office for review.

Doña Ana County District Attorney Mark D’Antonio cleared the law enforcement officers of wrongdoing.

A Border Patrol agent convicted of coercing a 15-year-old girl to have sex with him in 2014 and 2015 was sentenced Thursday to 29 months in prison.

Orland Gomez, 43, of Las Cruces, was arrested in August 2016 after the victim revealed the inappropriate relationship to a relative, KVIA reports

The victim told authorities that Gomez threatened to kill himself if she didn’t have sex with him.

Gomez was convicted after pleading no contest to two counts of criminal sexual penetration of a minor in the fourth degree.

The victim urged the judge to impose the maximum sentence of 36 months.

“I commend the victim in this case for the courage she demonstrated in coming forward to report this crime,” Doña Ana County District Attorney Mark D’Antonio said. “But for the courageousness of this young girl and victims like her, too many of these crimes would go unreported and unprosecuted.”

Gomez also is required to registers as a sex offender for the rest of his life.

A man who authorities initially believed was shot by Border Patrol agents at a Las Cruces checkpoint in New Mexico last month has died. 

CBP officials originally said agents shot the man after he pointed a gun at them on April 9. But now officials said the man shot himself, KFOX14 reports

Agents fired their weapons at the man after they heard a gunshot.

No agents were injured.

The man’s identity has not been released by CBP.
