Republican Congressmen Demand Whitehouse be Included in Leak Investigation

Could White House officials have accidentally leaked news that tripped up a Western intelligence operation targeting Al Qaeda’s affiliate in Yemen?

Two Republican congressional leaders want the formal FBI inquiry to answer that question, reports Reuters.

Monday, Rep Peter King, chairman of the House Committee on Homeland Security, sent a letter to FBI Director Mueller requesting that the FBI investigation of alleged leaks cover the White House, including the National Security staff. Later, Reuters says Sen. Saxby Chambliss, vice chairman of the Senate Intelligence Committee, sent Mueller a fax seconding that request.

These questions were triggered by last week’s Reuters story which brought a potential White House slip-up to light. In response, the White House has strongly denied that sensitive information was leaked stating, “No one is more upset than us about this disclosure, and we support efforts to prevent leaks like this which harm our national security.”

Dallas U.S. Atty. Says Holder and Pres. Had No Hand in Decision Not to Prosecute Muslim Leader

The U.S. Attorney in Dallas has stepped into the controversy over the decision not to prosecute a former founder of the Council on American-Islamic Relations (CAIR).

Rep. Peter King (R-N.Y.) claimed Atty. Gen. Eric Holder shut down the probe into former CAIR leader Omar Ahmad for fear of offending Muslim groups.

But the  Dallas Morning News reported that Dallas U.S. Attorney James Jacks, who was involved in the investigation,  said that Holder and President Obama had no hand in the decision not to prosecute, and politics played no part.

“Since late 2007, I am the only attorney in this office that was involved in the investigation he referred to,” Jacks said in a statement to the newspaper. “If someone is telling [King] that the attorney general or the White House intervened to decline a prosecution in this matter, he is being misinformed. That did not happen.”

“The decision to indict or not indict a case is based upon an analysis of the evidence and the law,” Jacks said. “That’s what happened in this case.”

Rep. King told Politico: “I stand by my position entirely.”

Holder recently said Bush Justice Department also passed on the opportunity to prosecute the same person.

Rep. Peter King is busting the chops of the Justice Department, claiming the department overruled fed prosecutors and FBI agents who wanted to file  charges against unindicted co-conspirators  in  a prosecution of a  Texas-based Muslim charity —  the Holy Land Foundation — which had ties to Hamas in Gaza, the Washington Times reported.

King, a New York Republican who chairs the House Committee on Homeland Security, sent a letter on Monday to Attorney General Eric H. Holder Jr. asking that he answer questions regarding the 2008 terrorism-financing prosecution, the Washington Times reported.

“I have been reliably informed that the decision not to seek indictments of the Council on American-Islamic Relations (CAIR) and its co-founder Omar Ahmad; the Islamic Society of North America (ISNA); and the North American Islamic Trust (NAIT) was usurped by high-ranking officials at Department of Justice headquarters over the vehement and stated objections of special agents and supervisors of the Federal Bureau of Investigation, as well as the prosecutors at the U.S. Attorney’s Office in Dallas, who had investigated and successfully prosecuted the Holy Land Foundation case,” King stated.

King also wants to know if the White House intervened in the matter, the Times reported.

“I believe that in order to maintain the credibility of the department, there should be full transparency into the department’s decision,” King stated.

Dean Boyd, a Justice Department spokesman, issued a statement to ticklethewire.com disputing the allegations:

“The Justice Department brings prosecutions based on the facts and the evidence, nothing more or less. The investigation, prosecution of the Holy Land Foundation for Relief and Development and five of its leaders for providing material support to Hamas, and determination of whether to charge unindicted co-conspirators, were guided only by the law and the facts; any suggestion to the contrary is false and unfounded.”

“The notion that an individual suspect or organization is immune from Justice Department prosecution solely because of their affiliations, memberships or political leanings is not only false but an affront to Department prosecutors nationwide who bring charges against defendants daily without regard to such considerations.”

NY Cop Who Cracked Copycat Zodiac Killer Case Assigned to Homeland Security Committe in Washington

Star New York cop Joseph Herbert, who cracked the Zodiac copycat killer case in 1996, has been assigned to work as an expert on the Homeland Security Committee, the New York Daily News reported.

The Daily News reported that Herbert becomes the first New York cop to be assigned to a Congressional Committee.

“Inspector Herbert is just an incredible addition to the committee,” Rep. Peter King (R-N.Y.) , chair of the committee, told the Daily News. “He brings the expertise of the No. 1 counterterrorism police unit in the country. It gives us a tremendous source of knowledge.”

Inspector Herbert, 53, who heads the NYPD’s Intelligence Operations and Analysis Section, cracked the copycat Zodiac killer case as a detective in 1996. The killer Heriberto (Eddie) Seda, shot to death three people and wounded four others between 1990-1993.

Update: Attorney Gen. Eric Holder Jr. said the Justice Department will prosecute anyone found to have violated U.S. law in the leaks, the Associated Press reported.”To the extent that we can find anybody who was involved in the breaking of American law, who put at risk the assets and the people I have described, they will be held responsible; they will be held accountable,” Holder said at a news conference, according to the AP. He called the WikiLeaks probe “an active, ongoing criminal investigation.”

Rep. Peter King (R-NY) is urging Attorney Gen. Eric Holder Jr. to designate WikiLeaks as a “foreign terrorist organization”, saying it “posed a clear and present danger to the national security of the United States,” the New York Daily News reported.

The request came  as the White House condemned the leak, saying some who help the U.S. abroad could be harmed, the paper reported.

WikiLeaks published 250,000 diplomatic cables from classified projects, exposing back-channel communications, some embarrassing to the U.S., foreign nations and individuals.

The Daily News reported that the leaks included information that Saudi Arabia has urged the U.S. to launch air strikes on Iran’s nuclear program.

“Cut off the head of the snake,” the Saudi ambassador to Washington urged Gen. David Petraeus, who commands U.S. forces in Afghanistan.
