Hunter Biden is requesting a judge dismiss the gun charges against him, pointing to an agreement his team arranged with the Justice Department earlier this year.

Although the Justice Department claims the deal was never officially settled, Biden’s legal team insists it’s still valid, Politico reports.

The deal contained provisions safeguarding him from criminal charges.

Biden’s legal team argues that the agreement not only covers his current gun charges in Delaware, but also extends to shield him from recent criminal tax charges filed against him in California.

On Monday, Biden’s legal team presented its case in a series of motions before U.S. District Judge Maryellen Noreika, seeking dismissal of the gun-related charges against Hunter Biden. The charges include unlawful gun ownership as a drug user and alleged falsification on a federal gun purchase form.

His legal team also contends that the Second Amendment should make it illegal to ban firearm possession for drug users.

Additionally, his lawyers argued that the appointment of a special counsel to investigate Biden violated Justice Department protocols. They called the case “selective and vindictive prosecution” that was influenced by Republican pressure.
