Former President Trump is urging the Supreme Court to reject the Justice Department’s request to promptly determine whether he can be indicted for trying to overturn the 2020 election.
Last week, special counsel Jack Smith asked the top court to expedite the ruling on whether Trump can avoid prosecution because of presidential immunity.
On Wednesday, attorneys for Trump asked the Supreme Court to deny Smith’s request to make a swift decision, ABC News reports.
“The Special Counsel contends that ‘[i]t is of imperative public importance that respondent’s claims of immunity be resolved by this Court,'” Trump’s attorneys wrote in a brief to the high court.
Instead, the attorneys are arguing that justices should first allow a federal appeals court to consider the case.
The trial is scheduled for March 4 and could extend beyond the presidential election.
In August, Trump pleaded not guilty to charges against him in the election case.
He has frequently claimed that he has presidential immunity that shields him from prosecution for actions he took while in office.
