Jurors in Gotti Case Said Evidence Was Weak and Govt. Should Not Go For 5th Trial

One juror in the John “Junior” Gotti racketeering trial put it succinctly on Tuesday after the jury was hopelessly deadlocked and the judge declared a mistrial.

“The evidence was just not there to prosecute the guy,” said one of the jurors, who remained anonymous, according to the New York Times.

A group of jurors also said the government should not try to prosecute Gotti again.

The government said Tuesday that it had not yet decided whether to go for a fifth trial. This was Gotti’s fourth. The other three, just like this one, ended in mistrials after jurors failed to reach a unanimous decision.

Four jurors met with reporters Tuesday after the mistrial was declared and talked about the flaws in the government’s case.

The four jurors said they seemed to buy  Gotti’s defense that he had withdrawn from the mob long ago, according to the New York Times.

“The jurors said that of the 12 people on the panel, 6 did not believe that Mr. Gotti quit the mob, 5 did believe him and one remained undecided,” the Times reported.

The group also said they did believe John Alite, the government’s key witness, who is a “confessed hit man and a former member of Mr. Gotti’s crew,” the Times reported.

The jurors  said the government should quit trying to put Gotti behind bars.

“They should stop this now — it’s ridiculous,” said one of the jurors, a middle-aged man, according to the Times. Another juror, a woman, said of the prosecution: “It’s abusive. It’s almost become a mockery.”

Thanksgiving at the Gotti home may be filled with a little more laughter than at the homes of the New York  prosecutors and FBI agents who worked his case.

That’s because the odds of a mistrial for John Gotti Jr. are improving by the day.

On Tuesday, for the second time during the 9 days of  deliberations, federal jurors in New York let the judge know they were deadlocked and couldn’t reach a unanimous verdict in the racketeering trial that includes allegations of murder and drug trafficking, the Associated Press reported.

U.S. District Judge Kevin P. Castel rejected the defense request to declare a mistrial and ordered the jury to continue deliberating, AP reported.

“This trial has been conducted at considerable expense and human effort to both the government and the defendant,” the judge told them, according to AP. “If your deliberations do not end in a verdict, in all likelihood it would have to be tried again before another jury.”

The jury is expected to cut off at 2 p.m. Wednesday and return Tuesday. This is Gotti’s fourth trial. The other three ended in mistrials after the jury deadlocked.

The case against mobster John Gotti Jr. went to the jury for deliberations  in Manhattan federal court, but not before  some last minute drama on Tuesday.

Yes, for a while Tuesday morning, the defendant himself did not want to leave his jail cell to show up in court for the closing arguments in a case in which federal prosecutors have accused him of everything from conspiracy to murder to drug trafficking.

The New York Times reported that “in the middle of closing arguments, it evinced a new, unexpected — and rather odd — level of legal fatigue when the defendant himself, perhaps annoyed by the drawn-out process, or maybe just bored by the ordeal — refused to leave his cell and come to court.”

Mr. Gotti “did not wish to continue with the trial,” a United States marshal told the judge, according to the Times.

The paper reported that Gotti’s attorney Charles Carnesi was surprised by his client’s antics, saying: “No one knows anything from Mr. Gotti directly.”

A couple hours later, Gotti, without any real explanation, showed up in a “short-sleeved shirt and an irritated scowl”, the paper reported.

This is Gotti’s fourth trial. The other three resulted in mistrials. The big question is: Will the prosecution give up if it fails to get a conviction this time?

Prosecution in Closing Arguments Says Gotti Ran Massive Cocaine Trafficking Operation

It’s now down to the final lap: closing arguments in racketeering trial of John Gotti Jr. Prosecutors hope they can nail it this time after seeing the last three trials end in a mistrial.

On Monday, during closing arugments, the prosecution told a federal jury in New York that Gotti built and “ran a massive cocaine trafficking operation”, according to the New York Daily News.

Assistant U.S. Attorney Jay Trezevant told jurors Gotti did “whatever was necessary” to run the drug operation, the Daily News reported. The defense was scheduled to deliver its closing in the afternoon.

As expected, the New York racketeering trial of mobster John Gotti Jr. has been flush with drama.

On Wednesday, after the judge dismissed two jurors who weren’t getting along, Gotti’s mother loudly voiced her opinion from the gallery, not far from where her son sat.

“They’re railroading you!” Victoria Gotti shouted, according to the Associated Press. “They’re doing to you what they did to your father.”

Meanwhile, Gotti’s attorneys on Wednesday won a victory when the judge ruled that the jury can hear evidence  contained in an FBI report that a top mobster approved killing Gotti after he said he had quit the mob.  The paper reported that the evidence could bolster Gotti’s claim that he quit the mob in 1999.

The New York tabloids are having a blast with a jury dispute in the federal trial of mobster John Gotti Jr.

One juror  wrote a note to the judge voicing concern about a fellow loud mouth juror.

“There’s more infighting on the Gotti jury than at a gangland sitdown – and they’re not even deliberating yet!,”  the New York Daily News reported last week.

A note signed by “A Concerned Juror” said:
“She announced that we the jurors better be prepared to be deliberating until after the Christmas holiday because … she is not going to allow any f—— body to rush her,” the two-page letter said.

The note also complained that the juror, a 34-year-old postal worker — was ogling “defense attorney Mr. Charles Carneglia,” the Daily News reported.

The juror complained that the loud juror also “charged a takeout order of fried calamari to the court’s tab when the panel visited a local restaurant,” the newspaper reported.

The judge has not removed the juror, but did interview all the jurors to determine if the loud-mouthed juror had discussed the case, read  about it or got information from outside the courtroom, the Daily News reported. Gotti faces a variety of charges including racketeering and murder.

It is his fourth trial in five years. The other three ended in a mistrial.

NEW YORK – The fourth racketeering trial of John “Junior” Gotti began yesterday with the government portraying the mob heir as a maniacal killer and chronic criminal who has dodged prison by intimidating witnesses and obstructing justice.

Gotti’s lawyer, Charles Carnesi, tried to debunk that picture by telling a jury in US District Court in Manhattan that federal prosecutors have assembled a cast of mob killers trying to win leniency for their crimes by testifying that Gotti ordered assaults and murders.

Carnesi said Gotti, 45, never had anything to do with killings in the late 1980s and early 1990s of two drug dealers, despite claims of the witnesses, including one who could have faced the death penalty if convicted of charges he faced before he began cooperating.

There’s still a big public fascination with the Gotti family. But the judge isn’t so fascinated to the point that he’s willing to move forward without more evidence on the table.

NEW YORK –A Manhattan judge is giving John A. (Junior) Gotti’s prosecutors a week to put up or shut up.

During a pre-trial hearing Wednesday, Federal Judge Kevin Castel quizzed Assistant U.S. Attorney Elie Honig on why he hasn’t offered details of crimes the mob scion allegedly committed in the five years before his 2008 indictment.

“Is that it?” Castel prodded the prosecutor.

The feds say that during the 1980s and early 1990s, the Dapper Don’s kid had a hand in three gangland slayings and trafficked in drugs.
