Federal prosecutors plan to seek an indictment of Hunter Biden by Sept. 29, according to new court filings by special counsel David Weiss.

The move confirms that prosecutors are moving ahead with a criminal case against President Biden’s son in connection with his purchase of a pistol in 2018, The New York Times reports

Prosecutors and Biden had reached a plea deal to resolve charges related to the gun and his failure to pay taxes. But the agreement fell apart in July.

Biden is accused of illegally possessing a firearm while he was a drug user.

He also is under investigation for his business dealings, but the court filing makes no mention of that case. Last month, prosecutors indicated they planned to file tax charges in California or Washington D.C.

Biden’s attorney, Abbe Lowell, said in a statement that he plans to challenge any attempt to take the criminal case to trial, saying the original plea deal “remains valid and prevents any additional charges from being filed.”
