Boston Marathon Bomber May Be Sentenced to Most Isolated Prison in U.S.

Boston Marathon bomber Dzhokhar Tsarnaev faces two likely, grim possibility – the death sentence or life in one of the most destructive prisons in America, “a place so isolating that it has been called a clean version of hell,” NBC News reports. 

The United States Penitentiary Administrative Maximum Facility in Colorado, also known as ADX or supermax, is reserved for the most dangerous criminals, such as terrorists.

Tsarnaev’s defense team on Wednesday argued against placing Tsarnaev at ADX, which is a 490-cell prison in the foothills of the Colorado Rocky Mountains, saying he would become so isolated that he’d be separated from the world forever.

In ADX, prisoners are confined to their cell for 23 hours a day in solitary confinement in 12-by-7-foot cells with a little window and thick walls. Meals are handed through a slot in the door.

“It breaks down the human spirit, it breaks down the human psyche. It breaks your mind,” former supermax inmate Garrett Linderman told CBS’ 60 Minutes in 2009.

 

Friends of Alleged Boston Marathon Bomber Accused of Dumping Backpack of Evidence

Friends of the alleged Boston Marathon bomber are accused of dumping a backpack belonging to Dzhokhar Tsarnaev in an attempt to hide evidence against him, Reuters reports.

When the FBI approached the friends about the backpack, they “simultaneously” responded that it had been thrown into a dumpster, according to testimony against one of the friends, Azamat Tazhayakov, who has been charged with interfering with the investigation.

The friends told the FBI that the backpack was removed from Tsarnaev’s room three days after the attack.

They told me simultaneously that the backpack had been placed in the dumpster and that a refuse truck had removed the dumpster from the location the previous day,” FBI Special Agent John Walker said.

The backpack was later recovered in a landfill. Inside were fireworks with the gunpowder removed, a spiral notebook and a jar of Vaseline.

Roommate of Boston Marathon Bombing Suspect Surprised by Friend’s Visit

Just hours after the FBI released photos of the Boston Marathon bombing suspects, the roommate of one of the accused mass killers said he was surprised when someone came over to retrieve some of Dzhokhar Tsarnaev’s belongings, the Boston Globe reports.

Andrew Dinwell was testifying in the obstruction-of-justice trial of Azamat Tazhayakov, who rummaged through Tsarnaev’s room. Dinwell said the friend appeared to take a bag of marijuana but couldn’t recall whether anything else was taken.

“This was abnormal,” Dwinells said of the friend’s visit Tuesday in federal court in Boston.

Tazhayakov is one of three charged with interfering with a terrorism investigation.

All three are being tried separately.

The FBI was closely monitoring a friend of the suspected Boston Marathon bombers last year and even urged him to avoid Boston’s Fourth of July fireworks, the Boston Globe reports.

The agents were ordered to “make sure they stay with Mr. [Khairullozhon] Matanov, and don’t lose him,” Special Agent Timothy McElroy told US Magistrate Judge Marianne B. Bowler in court.

Prosecutors said the 23-year-old Matanov, who was charged with obstruction of justice last week, lied about interacting with the brothers on the week of the attack.

The FBI told Matanov to stay away from the fireworks and the Boston Marathon to avoid alarming people.

Matanov, a native of Kyrgyzstan, faces up to 20 years in prison.

Friend of Boston Marathon Bombers Sent Money to Six Countries Using Fake Names

A friend of the Boston Marathon bombing suspects is accused of sending more than $71,000 to six countries, often using fake names between 2010 and 2013, the Associated Press reports.

An FBI agent spoke of the money during testimony at a hearing Wednesday.

The friend, Khairullozhon Matanov, stopped sending them money when one of the suspects was in Russia. the agent testified.

Matanov also is accused of lying to investigates and deleting computer files.

How is it possible that the FBI agent who shot and killed an associate of a suspected Boston Marathon bomber has been pocketing more than $50,000 annually in disability benefits since he retired as an Oakland, California, police officer in 2004 at age 31?

On May 22, 2013, Ibragim Todashev of Orlando, Florida, allegedly had just confessed to helping the late Tamerlan Tsarnaev kill three men two years earlier, when he threw a coffee table at an FBI agent and charged a Massachusetts state trooper with a pole.

The agent fired seven shots. Todashev died. Two investigations found that the agent, named Aaron McFarlane, according to The Boston Globe, had acted in self-defense.

During a police corruption trial of the infamous Oakland Riders, who were acquitted, McFarlane pleaded the Fifth Amendment when questioned about filing a false police report. He repeatedly injured a leg and an ankle while on the force and retired on medical disability.

Why is he on disability? I don’t know. CalPERS, the state-administered retirement fund, can reveal only that he is collecting an annual pension of $52,000 essentially for life. If McFarlane has a physical disability, it was not so debilitating as to prevent him from passing a background check and training at the FBI’s academy in Quantico, Virginia.

Privacy laws prohibit government agencies from revealing the nature of McFarlane’s disability. So readers will have to imagine for themselves how a former cop can be so disabled as to receive some $500,000 over the past decade yet still qualify for working as an FBI agent.

FBI Agent Who Shot Todashev in Florida Is Subject of Probe Over His Annual Police Pension

The FBI agent who fatally shot a friend of one of the Boston Marathon bombing suspects in his Florida apartment is the subject of an investigation over a $52,000 pension that he’s receiving as a retired police officer from Oakland, California.

The Boston Globe reports that Aaron McFarlane has been receiving the pension since he was 31 years old in 2004.

What’s bizarre about his pension is that he began collecting it for medical reasons, yet he managed to pass the rigorous physical requirements of the FBI when he landed the job in 2008.

The city of Oakland is investigating.

Did FBI Agents Violate Rights of Boston Marathon Bombing Suspect During Aggressive Interrogation?

The FBI’s interrogation of Boston Marathon bombing suspect Dzhokhar Tsarnaev violated his rights while he he lay in pain in a hospital bed immediately following his arrest, his defense lawyers argued in court documents Wednesday.

The Chicago Tribune reports that FBI agents ignored Tsarnaev’s 10 requests for a lawyer even though authorities determined further dangers to the public did not exist.

“The questioning continued for hours, in what was obviously an effort to extract as much incriminating information as possible, without regard for the protections of the Fifth Amendment,” his lawyers wrote in the 21-page filing.

Lawyers are asking for the hospital statements to be suppressed because he was heavily sedated and in a lot of pain during the interviews.

Tsarnaev, 20, is charged with killing three people and wounding more than 260 others with his brother, Tamerlan, who was killed during a manhunt for the duo.
